This is an appeal from a judgment dismissing the complaint of Wisconsin Builders, Inc., plaintiff-appellant (hereinafter plaintiff)
in an action to recover on a builder's risk policy of insurance issued by General Insurance Company of America, defendant-respondent
(hereinafter defendant). The policy provided coverage, with certain exclusions, for risks of direct physical loss to an apartment
building being constructed by the plaintiff in Appleton, Wisconsin. The defendant's insurance contract excluded loss caused
by certain types of earth movement. The case was tried to a jury which determined that the loss was caused by earth movement
within the exclusionary clause of the insurance contract. The apartment was being constructed at the foot of a bluff in an "L" shape so that the corner of the bluff bisected the inside
angle of the "L." One wing of the building ran north and south along the west side of the bluff; the other wing ran east and
west along the south side of the bluff.
